This End User License Agreement (“Agreement”) is between you and Agastya App, (“us”, “we”, “our” or “Agastya App”) and governs the use of “Agastya” app (“the app”) made available through the Google Play Store. By installing the app, you agree to be bound by this Agreement and understand that there is no tolerance for objectionable content. If you do not agree with the terms and conditions of this Agreement, you are not entitled to use the app. In order to ensure that Agastya App provides the best experience possible for everyone, we strongly enforce a no tolerance policy for objectionable content.
This Agreement is between you and Agastya App, (“Agastya App”) only, and not Google, Inc. ("Google") or Facebook, Inc. ("Facebook"). Notwithstanding the foregoing, you acknowledge that Google or Facebook and their subsidiaries are third party beneficiaries of this Agreement and Google or Facebook has the right to enforce this Agreement against you. Agastya App, not Google or Facebook, is solely responsible for the app and its content.
We may collect and use information about your usage of the app, including certain types of information from and about your device. We may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the app. See also our Privacy Policy.
We take steps to ensure that your information is treated securely and in accordance with this policy. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your information, for example, by encryption, we cannot guarantee the security of your information transmitted through the Platform; any transmission is at your own risk.
We have appropriate technical and organizational measures to ensure a level of security appropriate to the risk of varying likelihood and severity for the rights and freedoms of you and other users. We maintain these technical and organizational measures and will amend them from time to time to improve the overall security of our systems.
We will, from time to time, include links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any information to these websites.
We use the following criteria to determine the period for which we will keep your information:
We will not retain sensitive personal data or information for longer than is required for the purposes for which such information may be lawfully used or is otherwise required under any law for the time being in force.
After you have terminated your use of our Services, we can store your information in an aggregated and anonymized format. Notwithstanding the foregoing, we can also retain any personal information as reasonably necessary to comply with our legal obligations, allow us to resolve and litigate disputes, and to enforce our agreements.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for your personal, non-commercial purposes. You may only use the app on Android devices that you own or control and as permitted by the Play Store Terms of Service.
By using the app, you represent and warrant that (a) you are 13 years of age or older and you agree to be bound by this Agreement; (b) if you are under 13 years of age, you have obtained verifiable consent from a parent or legal guardian; and (c) your use of the app does not violate any applicable law or regulation. Your access to the app may be terminated without warning if we believe, in our sole discretion, that you are under the age of 13 years and have not obtained verifiable consent from a parent or legal guardian. If you are a parent or legal guardian and you provide your consent to your child’s use of the app, you agree to be bound by this Agreement in respect to your child’s use of the app.
Agastya App disclaims all warranties about the app to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, Agastya App, not Google or Facebook, shall be solely responsible for such warranty.
Agastya App does provide minimal maintenance or support for it but not to the extent that any maintenance or support is required by applicable law. Agastya App, not Google or Facebook, shall be obligated to furnish any such maintenance or support.
Agastya App, not Google or Facebook, is responsible for addressing any claims by you relating to the app or use of it, including, but not limited to: (i) any product liability claim; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that you may have such claims.
Agastya App shall not be obligated to indemnify or defend you with respect to any third party claim arising out of or relating to the app. To the extent Agastya App is required to provide indemnification by applicable law, Agastya App, not Apple, shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the app or your use of it infringes any third party intellectual property rights.
